We are a subcontractor with a firm fixed price contract with a prime.  We have a CBA that reflects that H&W rates will be determined each year in Oct. The option period for this contract is 1 OCT.  This year the H&W rate went up based on calculations done in Oct the calculations are based on the previous years cost.  The government this year said that because we do the calculation in Oct after the option is exercised they will not pay the new rate until next year.  Now we have been asked to price new IDIQ work under the existing contract and we included the new H&W rates as that is the actual cost of the ...
