As the economy continues to slow, a number of experts anticipate a virtual flood of bankruptcies and restructurings in the coming months. U.S. consumer bankruptcy filings already jumped nearly 31% last month versus a year ago, according to the American Bankruptcy Institute (ABI), citing data from the National Bankruptcy Research Center (NBKRC). Moreover, ABI says the total number of U.S. bankruptcies filed during the first three months of 2008 increased almost 27% over the same period in 2007 in all bankruptcy court districts, according to data released by the Administrative Office of the U.S. Courts. “At current trends, ...

Pajamas Media ยป California Will Be Bankrupt Before General Motors
Turkey was once known as “the sick man of Europe.” Michigan fills a similar role in the minds of many Americans, a basket case of a state on the edge of a financial precipice. This has been the popular view of Michigan for at least 20 years, since Michael Moore’s “documentary” Roger and Me portrayed Flint as devastated by GM’s efforts to modernize the giant automaker. Michigan’s image is that of an economic disaster zone, filled with decaying cities, greedy unions, stupid companies, and general incompetence. Many city and county governments are distressed financially, and the business ... market research, surveys and trends

Doug Kass's 20 Surprises Of 2009
partner Doug Kass was kind enough to send us his 20 surprise predictions for 2009. As Doug explains, these predictions are outliers, not events that have a high likelihood of occuring (if they did, they wouldn't be surprises). In late December over the past six years, I have taken a page from former Morgan Stanley strategist Byron Wien (now the chief investment strategist at Pequot Capital Management) and prepared a list of possible surprises for the coming year. These are not intended to be predictions but rather events that have a reasonable chance of ... industry trends, business articles and survey research

Lehman, Rangers, White Energy, Brown, Strauss Auto, Crunch: Bankruptcy
are forming lines of battle for and against the idea of substantively consolidating all of the Lehman companies under a Chapter 11 plan. In late June, creditors with $15.5 billion in claims against the Lehman holding company filed papers favoring substantive consolidation of the 23 Lehman affiliates. In substantive consolidation, the assets from all Lehman companies would be thrown into one pot and all unsecured creditors would receive the same distribution regardless of the particular company that owed the debt. Bank of New York Mellon Trust Co. filed papers on July 15 saying that the argument for substantive consolidation is ... market trends, news research and surveys resources

An example of financial restructuring would be to add debt to lower the corporation's overall cost of capital. For otherwise viable firms under stress it may mean debt rescheduling or equity-for-debt swaps based on the strength of the ...
