I have a new client who was unaware of the income limits on Roth IRA contributions. In 2005, 2006, and 2007 they made ineligible contributions to their Roth IRA. My reading of the rules is that they have to withdraw the money, pay a 6% penalty per year on the original excess amount, and pay income tax and the early withdrawal penalty on any gains. Am I reading that right? If they had just made after tax contributions to a traditional IRA and converted that to a Roth IRA this year they would be ok.
