QUESTION: I have a single family investment property that is deeply under water. This property is in foreclosure proceedings and located in Illinois which is a Judgement allowed state. Primary Mortgage lender, BAC, is willing to work a Deed in Lieu since we are unable to do short sale because of the distressed area and grim real estate market. But they have refused to negotiate unless we get the second lien removed. I also had a HELOC through the secondary lien holder, Charter One Bank, who refuses to go down below 50% of the actual loan amount to settle the charges.
