Last week, Congressman Thaddeus McCotter (R-MI) introduced a bill that would require certain Internet websites that contain personal information of an individual to remove such information at the request of the individual. This bill potentially affects “[a]ny Internet website that makes available to the public personal information of individuals.” The bill also defines “personal information” as “any information about an individual that includes, at minimum, the individual’s name together with either a telephone number of such individual or an address of such individual.” Megan’s Law . ...
is called "common law" and it binds future decisions. In cases where the parties disagree on what the law is, an idealized common law court looks to past precedential decisions of relevant courts. If a similar dispute has been resolved in the past, the court is bound to follow the reasoning used in the prior decision (this principle is known as stare decisis ). If, however, the court finds that the current dispute is fundamentally distinct from all previous cases (called a " matter of first impression "), judges have the authority and duty to make law by creating precedent . Thereafter, the new decision ...

AMERICAblog Gay: AP legal reporter gets law wrong; Obama defender ...
As I noted last night, AP reporter Denise Lavoie interviewed an Obama defender, Robert Raben, and didn't bother mentioning that the guy is a lobbyist, who lobbies the White House itself, who is paid to give advice to lobbyists on this very issue, and who thus has a financial interest in maintaining good relations with the White House. Did it affect his quote in the AP story? We'll never know since AP didn't bother disclosing who he really is. But there's more to the story. The AP reporter, who is AP's legal affairs writer, got the story wrong. Which is pretty bad, since she's supposedly ... market research, surveys and trends

Why the Defense of Marriage Act Is a Legal Albatross
Fourteen years ago, Congress enacted the Defense of Marriage Act, one of the worst pieces of federal legislation ever passed. The law was always unnecessary and unwise. And on Thursday, a federal court in Massachusetts ruled that it is also unconstitutional. The main impetus behind the 1996 law was the fear among conservative politicians and activists that if Hawaii -- where a same-sex marriage lawsuit had been filed -- issued marriage licenses to same-sex couples, the other 49 states would have to recognize them. But that fear was always unfounded because courts had never held that states were constitutionally required to ... market trends, news research and surveys resources

U.S. Copyright Office - Fair Use
One of the rights accorded to the owner of copyright is the right to reproduce or to authorize others to reproduce the work in copies or phonorecords. This right is subject to certain limitations found in sections 107 through 118 of the copyright law ( title 17, U. S. Code ). One of the more important limitations is the doctrine of “fair use.” The doctrine of fair use has developed through a substantial number of court decisions over the years and has been codified in section 107 of the copyright law. WikiAnswers - What is the difference between an act and a law
An "Act" is a "... written ordinance of Parliament, Congress, etc." whereas a law is "a rule or system of rules recognized by a country or community as regulating the actions of its members and enforced by the imposition of penalties." Acts are made by the consensus between the two parts of a bicameral legislature for example, a law however may (for example in the United Kingdom) be made by an "enabling act" allowing a government minister to make sets of rules sometimes compiled with experts in the field, impractiable to do in Parliament.
