Last week, to help out with the closing of the books, as we were behind, my supervisor asked me to stay late to make sure everything was posted. I am an hourly employee, so I said: "Of course, I will get overtime, right, since I work 40 hours per week?" "No. I need this done, so you will have to stay, and get it done, and I need you to stay without pay, so it looks good for us that we got it all done." You know our jobs are on the line, bull crap, etc, etc. "But that is illegal ... if an hourly employee works more than 40 hours per week, or 8 in one day, the law says I must be paid OT." ...

CA overtime law says an employee gets paid 1.5 x for hours worked over 8 hours per day and hours worked over 40hrs per week. My question is: If someone works 9 hours each day for 5 days, that means they have 5 hours OT. Am I supposed to pay 1.5x for the 5 hours he worked over 8hr/day AND another 1.5x for the 5hrs he worked over 40hr/week? Which means, rather than 40hrs of regular time + 5hrs of overtime, I'd be paying 35hrs regular and 10hrs overtime.
