The General Office of the State Council of the People’s Republic of China issued the Administrative Measures on Domestic Partnership Enterprises Established by Foreign Enterprises or Individuals (the “Partnership Measures”) on December 2, 2009. The Partnership Measures arrived after almost three years of eager anticipation. China’s Ministry of Commerce (“MOFCOM”) published an initial draft of the foreign-invested partnership law in January 2007. China has issued new registration rules for foreign invested partnership enterprises (FIPEs), confirming that approval by the Ministry of Commerce will not be necessary for establishment of these entities. The rules will come into effect on 1 March.
