The legal system of the People’s Republic of China (PRC) is defined by the government as a “socialist legal system.”  Despite the official definition, however, China’s legal system is based primarily on the model of Civil Law.  The Constitution of the People’s Republic of China is the highest law within China.  The current version was adopted in 1982 with further revisions in 1988, 1993, 1999, and 2004. One of my favorite quotes I've heard in the time I've been in China, was from a middle-aged woman who told my girlfriend "in China we don't trust the legal system, if we need something taken care of we just hire some thugs." I thought it very well summarized the very well justified distrust the Chinese had of the legal system, and the nasty consequences it has for business at the bottom level (and political stability in general). I recently attended a presentation by one of National Australia Bank's up and coming stars, Nick Parsons. In his presentation Nick outlined the fact that if it had not been for the dynamic growth from China and India the last 24mths or so would potentially have been much worse from a global perspective. Considering that China is experiencing economic growth of c8.5% their economy should double in size in the next 10yrs or less. How do you access such a large but complex market?
