We are in the process of purchasing a REO property without Final Permint / Certificate of Occupancy. The house was build in 2006 while the builder occupied it for several months in 2007. The builder never filed and obtained the final permit. Lets assume that I took ownership of the property as is and obtained the final permit. I would like to know if it is possible for constractors or subcontractors to file lien against the property or to the new owner once final permit / certificate of occuancy is obtained. Under what situation can sub-contractors or other parties file lien claim agains the new owner. What other legals ...

I think what you are talking about is a mechanic's lien, which is legal if used in the appropriate circumstances. If the end user is smart, he should have taken some steps to prevent a mechanic's lien having any effect on his property, but you won't know that until you file. I am certainly not an attorney, nor am I trying to offer legal advice, but this sounds like something you should do - or attempt to do. Legal advice is clearly needed, I think, as laws vary from state to state and the bankruptcy will effect what can be enforced.
